BANGLI (June 7, 2021) - As a follow-up to the legal process "DD" for motorbike theft which is still ongoing, the Ministry of Social Affairs through Mahatmiya Bali Center is advocating through mediation and coordination with related parties so that "DD" still gets his rights as a child.

Present at the mediation were representatives from Mahatmiya Center, Tabanan District Attorney, Denpasar Penitentiary, Karangasem Fathers, Bangli District Social Service, Bangli State Junior High School 3, Bangli Regency Women's Empowerment and Family Planning Agency (BP2KB) as well as coaches from Gurukula Islamic Boarding School, where it is currently " DD" underwent the determination of the results of the Bangli District Attorney's hearing, namely attending education and training. Previously "DD" had received a diversion for his theft case in Karangasem Regency.

The initiation of this activity was carried out taking into account the psychological condition of "DD" who has undergone two legal processes and will undergo several more legal processes related to 10 pieces of evidence in 4 districts.

As a mediator, Section Head of Social Services and Rehabilitation Herlin Wahyuni Hidayat opened the activity by providing an introduction to the material on efforts to protect children against the law.

The mediation began with the submission of the position of "DD" in the legal process by the Head of the Legal Advisory Sub Division, Ni Luh Sri Eka Pariarsini. "For the position of the "DD" case, we will enter the prosecution stage. Actually, last week we had a trial but it was postponed, so tomorrow we will have a trial for the TKP in Tabanan with the theft of a motorbike," he explained.

He also said that in criminal cases there are things that need to be considered. "Each case has mitigating and aggravating factors, we will convey that tomorrow during the trial," added Eka.

Furthermore, the Head of Denpasar Class I Father's Child Client Guidance, Putu Yogi Hithawati explained that his party in the "DD" case was only carrying out the mandate of regulations and laws. "We really understand and appreciate holding this mediation to provide the best for the child. However, in the case of "DD" we have done our best for him. According to the law, diversion can only be given once in a lifetime and for as long as the child is and it is legal,” said Yogi.

"During that time, we will definitely fight for the child, but if we have given the best or reached an agreement on diversion but the child again violates the same case or in a different case, diversion can no longer be given, it is the standardization of the law," he added.

The concerns of various parties regarding the ongoing "DD" educational process were one of the things that emerged in the mediation, as stated by A.A. Kurniawan, a junior high school teacher where "DD" studied.

"During the education process at our school, "DD" never did anything negative or violated the rules," explained Kurniawan.

He also hopes that whatever the court's decision will be, hopefully, it can provide the best for "DD" in the world of education. "We from the school still hope that "DD" can follow the education he received at the Gurukula Pasraman, not being interrupted because of the court's decision," said Kurniawan.

The head of the Gurukula Pasraman, I Wayan Arsada as the party who received the "DD" during the diversion, said that this was in line with the school.

"This is where we cultivate the nature of trust, norms, and ethics regardless of the child's background. Is it possible that there is a loophole in the law so that "DD" can still accept the same decision?" he said.

I Wayan Arsada also said that while "DD" attended education and training at the Pasraman, he behaved well, politely, and followed the directions given by the educators.

The next response came from the Head of the Bangli District Social Service, I Wayan Karmawan, who has been overseeing this case since the start of the case. "Children may take a wrong step in dealing with a life problem, but if possible "DD" is given the best considering his psychological condition is down to face the trial," added Karmawan.

Mediation doesn't just stop there, tomorrow (08/06) the Center will meet with the Head of the Criminal Law Section of the Tabanan Kejari to discuss this case.
