MAGELANG (November 4, 2020) - The Ministry of Social Affairs is present again in fulfilling the rights of Children in Conflict with the Law (ABH) through "Antasena" Social Rehabilitation Center for Children in Need of Special Protection (BRSAMPK) in Magelang or better known as the Antasena Children's Center in Magelang. Wednesday, November 4, 2020. Sewon District Police, Bantul Regency, Yogyakarta Special Region entrusted 5 ABH at the Antasena Children's Center, Magelang.
The five ABHs are still in the process of being investigated by the Sewon Bantul Police because they were involved in mistreatment of 2 victims which resulted in both of them being seriously injured.
The five ABHs were entrusted at the Antasena Children's Center because the Sewon Bantul Police did not yet have a Children's Special Service Room. Based on the Juvenile Criminal Justice System Law (UU SPPA) No. 11 of 2012 Article 30 paragraphs (2) and (3) states that "Children who are arrested must be placed in the Special Child Service Room".
"In the event that the Special Service Room for Children does not yet exist in the area concerned, the child will be entrusted to the LPKS (Social Welfare Organizing Institution), hereinafter abbreviated as LPKS, is a social service institution or place that carries out the implementation of social welfare for children.
The Sewon Bantul Police Criminal Investigation Unit Head, Susmita Fracisca, said that currently investigators are seeking diversion. "Please supervise so that there is no internal conflict between the perpetrators, because one of the perpetrators had fled to the Kebumen area and his friends were annoyed," he explained.
"We are requested to process children's laws according to the SPPA Law, especially regarding the child care period and subsequent legal processes," said Head of Assessment and Social Advocacy at the Antasena Magelang Children's Center, Arif Nurhidayat.
Article 33 of the SPPA Law no. 11 of 2012 states that the period of child care at the Social Welfare Organizing Institution (LPKS) is a maximum of 15 days.
Based on the results of the initial assessment, the five ABHs were members of a gang. They beat 2 of their victims due to conflicts between gangs. The beatings were carried out using sharp weapons including sickles, samurai, and iron chains.
